‘I WAS FALSELY IMPLICATED IN DEFILEMENT’

A 44-year-old man yesterday told a Kitwe’s magistrate court that he was falsely implicated in a defilement case by the mother of the victim after she failed to pay him back K700 she owed him.

Chomba Kapembwa of Mulenga Township said in his defence, before Resident Magistrate Malota Phiri, that he was not in Kitwe on September 30, last year when the alleged defilement took place.

Kapambwe said he was in Solwezi from September 27 to October 1, last year on a business trip at the time the alleged offence took place and when he returned he was just home.

He is charged with defilement and particulars of the offence are that on September 30, last year, Kapambwe had sex with a 13-year-old girl.

He said he had falsely been implicated in the matter by the victim’s mother because of her failure to pay him K700 she owed him.

The court heard that the following morning after his return, his wife informed him that the neighbour was complaining that her daughter had been defiled in the bathroom.

Kapembwa said he was in the charcoal business with the victim’s mother and that on an unknown date but in September last year, the victim’s mother asked him to load some charcoal for her.

The Magistrate has since set December 9, this year for judgement after Kapambwe closed his defence.
